Pearson Planning, Chartered Surveyors has saved a private client £26,500 in developer contributions previously demanded by a local planning authority.  The Client had sought planning permission for housing and the authority had required payment of the money towards new Secondary school infrastructure provision.  This was via a legal agreement.  However, once the authority had appointed a contractor and the new High School was nearly completed, Pearson Planning applied under the Planning Acts to have the developer contribution waived.  The local planning authority agreed to do so, accepting arguments put forward by Pearson Planning, Chartered Surveyors.  Commenting on the decision, Euan FS Pearson said “There is a lesson to be learnt here.  Don’t ask developers for money for projects, 2 or 3 times over.  Contributions are only legal if necessary and required to overcome an impediment”.  If you have signed a legal agreement and are aggrieved, then why not speak to Pearson Planning?
