Dormer – A Game of Thrones
Most peoplle have heard of the concept of Localism i.e. taking decisions about local matters at a local level. However, do users of the planning system really undertsand what that means? For most householders it means the decision on a planning application being taken by an unaccountable member of staff at the local council. The perception of fairness is somewhat lost. In a recent case, regarding two roof dormers Pearson Planning, Chartered Surveyors represented Mr & Mrs M. Their architectural adviser had been trying to obtain planning permission. The power rested with Officers involved, and despite making changes to the design, permission was refused. With no automatic right of appeal in Scotland, Pearson Planning represented Mr & Mrs M when seeking a re-assessment by the Local Review Body. Councillors on the Body took no oral evidence, dismissed the matter without debate, in line with the recommendation of the Chair. Frustrated, Mr & Mrs M reapplied for exactly the same proposal on the advice of Pearson Planning, Chartered Surveyors. This time, as local residents & neighbours had written in support, the application was dealt with by Committee. The Committee has a diferrent Chair than that of the LRB. The Committee heard Euan FS Pearson and debated the proposal. Councillors decided to grant planning permission without voting. It must seem to the on-looker that planning is a Game, and the outcome depends on who is on the Throne.
