One Direction – Same Mistakes

Certain types of development may produce effects on the environment. Consequently, since 1992 there has been an Environmental Impact Assessment regime in place, and planning permission may not be granted if EIA has not been conducted. The EU has stated that EIA can cost an average of 66,000 euros (£55k in real money). However, where EIA is not mandatory, the local planning authority must give its opinion (‘Screening Opinion”)..
In a recent case, Pearson Planning, Chartered Surveyors sought a Screening Opinion for continued mineral extraction from a planning authority in South West Scotland. The Opinion given was that EIA was required. Not content with the explanation behind the Opinion, inquiries were made by Pearson.
The planning authority refused to provide information it had gathered/used. It was also discovered that no site visit had been made by the Planning Officer,
On this basis, Pearson Planning, Chartered Surveyors sought a Direction from the Government/Scottish Ministers. One Direction (EIA-DAG-141) was issued stating that the continued extraction would not have signifcant effects and that “EIA will not be required“. The Client is delighted as it will not have to spend vast amounts of money, unneccessarily.
