A Planning Authority has been forced to withdraw an Enforcement Notice and Stop Notice, following an appeal by Pearson Planning, Chartered Surveyors. The West of Scotland council served notices to stop the Tenant of a former pub car park being used for tyre fitting. Officers had previously recommended planning permission be granted. However, SNP councillors refused permission at Committee. The Committee Convenor failed to declare a potential conflict of interest. The Planning Manager was later found to have lied to the Committee, following a Stage 2 Complaint.

The tenant appealed and the Appointed Person (Mike Croft of Cumbria) dismissed the planning application appeal stating that the onsite containers were “unattractive”. Planning permission has been reapplied for, the containers repositioned and screened by timber fencing. Mr Croft could have allowed the appeal with a condition to that effect.

The Council promptly took enforcement action and the Tenant appealed. Local elections saw the SNP take a beating, with the Committee Chair not being relected. Labour now controls the Council. Subsequently, the Council withdrew the Notices. The newly formed Labour administration will reconsider the proposal at a forthcoming meeting of the Planning Committee. In the meantime, the tyre fitting business continues to operate, thanks to the advice & assistance of Pearson Planning, Chartered Surveyors.
