Occupancy Restriction Lifted on Farmer’s House

A Title restriction has been lifted, allowing the former operator of a guinea fowl business to remain in his on-site home. Pearson Planning, Chartered Surveyors argued that the occupancy condition was unnecessary, as the farm business has long ceased.  The Farmer was technically occupying the house unlawfully, as it was ‘tied’ to the guinea fowl business.  He had lived in the house for 20 years with the fear of eviction. The local authority could have served notice on him to vacate the premises, making him and his family homeless.  The Farmer was also facing retirement in the knowledge that he would be unable to sell the house on the open market.  Pearson Planning, Chartered Surveyors made a application under s75A of the Town & Country Planning Acts, and the local authority agreed to remove the occupancy condition.  Guinea Fowl is an alternative to Chicken on the dinner table, previously popular because of the bird’s lower calorie meat.
