Questions are being asked about the professional conduct of a local planning authority officer, after an Enforcement Notice, She served, was forced to be withdrawn.
The Notice alledged that a fence had been erected around amenity land to stop residents of adjacent flats using it. The 1.1m high post & wire fence was erected by the Owners, local farmers, so as to enclose their farmland.
The Notice was sent to the Owners at a non-existent address, even though the Officer (Claire Johnston) had been told the correct address of the Owners.
Royal Mail attempted to deliver the Notice to a person with the same surname, in the locality. Had that third party signed for the recorded delivery, the Owners would not have known about the Notice.
The Notice would have then taken effect and been unchallengeable.
The Notice eventually found its way to the Owners. Pearson Planning, Chartered Surveyors was instructed to appeal against the Notice.
On appealing the Council withdrew the Notice.
The Owners are still awaiting an apology from Johnston.
